Rape charges facing a Dunn County man were dismissed without prejudice this week.
Jeffery Thibault, originally of Alaska, appeared July 15 at the Stark County Courthouse for a status conference hearing on charges stemming from the alleged rape of an out-of-state woman on Nov. 8.
The alleged victim was unable to return to North Dakota for trial due to health issues unrelated to the alleged incident, which slowed down the trial process, according to Dunn County State’s Attorney Pat Merriman.
Thibualt’s public defender filed a motion to dismiss all rape charges, according to court records.
Merriman asked Southwest Judicial District Judge Dann Greenwood for an extension to allow more time for the woman – who has cancer – to give her deposition and appear for a trial jury in the case against Thibault. 
In light of the unusual circumstances concerning the alleged victim, Greenwood allowed Merriman two weeks to confer with the North Dakota States Attorney’s Office on laws to be able to request a hold on the case. It would also provide time to see how the alleged victim recovers from current treatment.
An agreement was made and approved by the courts July 22 to dismiss the case, but charges would be re-filed once the alleged victim is through with her medical treatment.
“It was the only viable option at this point until our victim recovers,” Merriman said.
